Liability Waiver

Please read this rental agreement and waiver in full, then sign at the bottom.

This Rental Agreement and Waiver is between FamilyInflatables LLC (“the Company”) and the person renting the equipment (“you” or “the Renter”). As the Renter, you confirm you are 18 or older and accept responsibility for the event — including supervising use, making sure everyone at the event follows the rules below, and the release and indemnification in this agreement. Each adult participant is responsible for their own acceptance of risk, and a parent or legal guardian is responsible for their own minor children.

1. Assumption of Risk

Use of inflatable equipment is a physical activity that carries inherent risks — including falls, collisions, sprains, strains, fractures, and other injury, and in rare cases serious or fatal injury. You understand these risks cannot be eliminated, and you voluntarily accept them for yourself and for those in your care.

2. Release of Liability

To the fullest extent allowed by law, you release and hold harmless FamilyInflatables LLC, its owners, employees, and agents from any and all claims, demands, or causes of action for injury, illness, death, or property damage arising out of the rental or use of the equipment, including claims arising in whole or in part from the ordinary negligence of FamilyInflatables LLC, its owners, employees, or agents, but excluding claims arising from the Company’s gross negligence or willful misconduct.

3. Indemnification

You agree to defend, indemnify, and hold FamilyInflatables LLC harmless from any third-party claims, damages, or expenses (including reasonable attorney’s fees) arising from the rental, to the fullest extent permitted by law — including those arising from improper or inadequate supervision, misuse of the equipment, violation of the safety rules, unauthorized movement or alteration of the equipment, unsafe conditions at your site, the acts of your guests or participants, or continued use during unsafe weather.

4. Rules of Use

You agree that you and every participant will follow these rules at all times:

  1. A responsible adult must actively supervise the inflatable at all times while in use.
  2. No shoes, glasses, jewelry, or sharp objects on the inflatable. No food, drink, gum, or silly string.
  3. No flips, rough play, wrestling, climbing on walls or nets, or piling on.
  4. Keep similar-sized participants on at the same time and stay within the posted occupancy limit.
  5. No drugs, alcohol, or open flames near the unit. Keep pets off and away.
  6. Do not move, unplug, or alter the equipment; only Company staff may set up or take down the unit.

5. Weather & Immediate Shutdown

The inflatable may not be used when sustained winds or wind gusts exceed the manufacturer’s stated maximum wind speed, or 15 mph, whichever is lower. If the unit begins to deflate, an anchor comes loose, the blower stops, electrical equipment becomes wet, severe weather approaches, or any other unsafe condition develops, all use must stop immediately — get everyone off the unit and contact the Company right away.

6. Medical Authorization

In the event of an injury, and if a parent or guardian cannot be reached, you authorize FamilyInflatables LLC to seek emergency medical treatment for a participant. You are responsible for any resulting medical costs.

7. Governing Law

This agreement is governed by the laws of the State of North Carolina. If any provision is found unenforceable, the remaining provisions stay in full effect.
